Gregorio Concepcion Tyquienco, a 72-year-old former federal juror, was sentenced to 30 days in prison followed by one year of supervised release for contempt of court. The sentencing took place on February 4, 2025, in the District Court of Guam. In addition to the prison sentence, Tyquienco was ordered to pay $1,537.04 as restitution for juror fees and mileage, a $2,000 fine, and a mandatory $25 special assessment fee.
Tyquienco served as a juror in the trial of United States vs. Raymond John Martinez and Juanita Marie Quitugua Moser at the District Court of Guam. Between October 11, 2018, and December 27, 2018, he disobeyed court instructions by discussing the case outside the jury's deliberative process. He talked about his potential verdict with William Topasna Mantanona and John T. Mantanona, known as "Boom," who was part of the defense team. Despite knowing Boom previously, Tyquienco did not disclose this connection to the court.
The discussions with William and Boom included requests for Tyquienco to be the jury foreman and deliver a "Not Guilty" verdict regardless of evidence presented. These actions violated orders from Chief Judge Frances Tydingco-Gatewood of the District Court of Guam. Following a mistrial declaration, Boom met with Tyquienco and gave him $1,100 in cash.
"Jury tampering is an affront to the Rule of Law," said United States Attorney Shawn N. Anderson. "Our citizens and the accused expect fair legal proceedings that result in justice." Anderson emphasized that this case demonstrates the Department of Justice's commitment to holding individuals accountable for violating public trust.
FBI Honolulu Special Agent in Charge David Porter commented on the importance of juror integrity: "Those who tamper with this important civic responsibility attempt to deny our communities the justice they deserve." He assured that the FBI remains committed to protecting legal processes.
The Federal Bureau of Investigation conducted the investigation into this case. Assistant United States Attorney Rosetta L. San Nicolas prosecuted it in the District of Guam.
