Honduran national indicted for failing to depart after removal order

The United States Attorney’s Office for the Middle District of Pennsylvania has announced the indictment of Noel Chinchilla-Avilez, a 26-year-old Honduran national. He faces charges for failing to leave the United States after receiving a final order of removal and for hindering his removal from the country.

Acting United States Attorney John C. Gurganus stated that the indictment claims Chinchilla-Avilez did not comply with the legal requirement to depart within 90 days following a final removal order and obstructed efforts to remove him from the U.S.

The investigation was conducted by Homeland Security Investigations (HSI), and Assistant United States Attorney Michael Scalera is handling the prosecution.

If convicted, Chinchilla-Avilez could face up to eight years in prison and a fine of $500,000. Sentencing would be determined by a judge based on federal sentencing statutes and guidelines.

It is important to note that indictments are merely allegations, and all individuals charged are presumed innocent until proven guilty in court.
