NFIB urges action on bill allowing lawsuits over personnel record deadlines

NFIB is urging its members to take immediate action concerning House Bill 1308, which proposes allowing employees to file lawsuits if deadlines for providing personnel records are missed. NFIB, a long-time advocate for low or no-cost administrative processes to address such complaints before legal action, objects to the bill's provisions.

NFIB's primary concern involves the "catch all" clause in the bill, which could potentially lead to employers being subjected to legal demands for documents that might not exist. This aspect of the bill also allows discharged employees to require written explanations for their termination.

On April 7, NFIB circulated an Action Alert to its members, encouraging them to contact their state Senators to request amendments to the bill. The amendments proposed by NFIB aim to remove the "gotcha" section and introduce an administrative procedure prior to the filing of lawsuits.

To ensure members have access to the Action Alert, NFIB advised them to contact Grassroots Manager Stacy Jenkins in case they did not receive the alert or have misplaced it.

NFIB emphasized that swift action is necessary, as the bill has already passed through the House and two Senate committees and is pending consideration by the full Senate.
