America First Legal (AFL) has taken action by filing an amicus brief in the U.S. Supreme Court case of Tamer Mahmoud v. Thomas W. Taylor. The brief opposes the Montgomery County, Maryland Public School District's mandatory gender identity and sexuality program, which AFL claims infringes on parents' rights to be informed or opt-out.

AFL emphasizes that "the Constitution recognizes and protects a parent’s right to direct the upbringing and education of his or her child." They argue that it is parents, rather than educational authorities, who should have the final say in their children's education.

Ian Prior, Senior Counsel at America First Legal, expressed concerns about the direction of public schools: “Schools across the country have abandoned their traditional roles of teaching students the fundamental values necessary to the maintenance of a democratic political system and are now compelling students and their parents to give the verbal salute to controversial political ideologies, with no dissent allowed." He specifically criticized Montgomery County Public Schools for being "at the forefront of this radical and unhealthy transformation."

Prior urged the Supreme Court to protect parental rights as guaranteed by the United States Constitution by ruling against MCPS's current policies.
