AFL calls for probe into Virginia schools' gender policies

America First Legal (AFL) has requested the U.S. Department of Education to investigate five public school systems in northern Virginia. The request targets Alexandria City, Arlington County, Fairfax County, Loudoun County, and Prince William County schools for alleged violations of Title IX of the Higher Education Act of 1972 and Executive Order 14190.

Title IX prohibits sex discrimination in public schools, including allowing males identifying as females access to girls' sports teams and facilities while denying such access to males identifying as male. Executive Order 14190 restricts federal funding for schools promoting "social transition" policies without parental consent.

The AFL claims that Alexandria City Public Schools' policy allows students access to facilities corresponding with their gender identity, which may change over time. Arlington County's policy mandates facility access based on gender identity and was reportedly involved in an incident where a male offender exposed himself in a girl's locker room.

Fairfax County's guidelines state that transgender students should not be required to use facilities conflicting with their gender identity. Loudoun County allows restroom use based on consistently asserted gender identity, defining it as an innate part of one's identity. Prince William County's regulation also supports facility access according to gender identity.

Reed D. Rubinstein from AFL stated: “Leftist public school administrators and teachers have...abused American parents’ rights and catastrophically failed our children." He emphasized the role of Executive Order 14190 in enforcing compliance.

Ian Prior from AFL remarked: “School districts in Northern Virginia have led the charge against science, reality, and the law by eliminating sex-based rights..." He warned that non-compliance could result in losing federal funding.
