Jason Michael Tucker, 43, of Frankford, was sentenced to two years in prison followed by three years of supervised release for being a felon in possession of a firearm.

Court documents and statements reveal that on December 30, 2022, Tucker sold a Ruger model Wrangler .22LR caliber revolver to a confidential informant for $125 in Greenbrier County. He admitted to the transaction and also acknowledged selling fentanyl to the same informant at the same location hours earlier.

Federal law prohibits individuals with prior felony convictions from possessing firearms or ammunition. Tucker was aware of this restriction due to his previous felony convictions for possession of a controlled substance with intent to deliver in Monroe County Circuit Court on August 30, 2018, and delivery of a controlled substance-marijuana in Greenbrier County Circuit Court on April 22, 2005.

Tucker's criminal history spans 23 years and includes additional felony convictions for forgery and entering without breaking.

United States Attorney Will Thompson commended the investigative work of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Greenbrier Valley Drug and Violent Crime Task Force. The task force comprises members from the West Virginia State Police, Greenbrier County Sheriff’s Department, and Lewisburg Police Department.

United States District Judge Frank W. Volk imposed the sentence. Assistant United States Attorney Andrew D. Isabell prosecuted the case.

This case is part of Project Safe Neighborhoods (PSN), a program aimed at reducing violent crime and gun violence through collaboration between law enforcement agencies and communities. The Department launched an enhanced violent crime reduction strategy for PSN on May 26, 2021, focusing on fostering community trust, supporting violence prevention organizations, setting strategic enforcement priorities, and measuring outcomes.

Further details can be found on the U.S. Attorney’s Office for the Southern District of West Virginia website or by searching Case No. 5:24-cr-17 on PACER.
